RE: The tariff classification of a generating set from Japan

Dear Mr. Sunakoda:

In your letter dated August 25, 1999, on behalf of Sumitomo Corporation of America, you requested a tariff classification ruling.

The merchandise is a steam-turbine generator set. The genset, driven by geothermal steam, consists of a steam turbine, an air-cooled turbo-generator and control system equipment. The AC generator with a production capacity of 64.8 megavolt amperes is directly coupled to the turbine. The control system equipment is used to regulate and monitor turbine speed, steam pressure, steam temperature and voltage. Several parts will be separately imported, including a bed plate and foundation bolt, which is listed as a part specific to the generator, and sub-sole plates. The question of the classification of parts relating to the turbine will be answered separately.

The applicable subheading for the generating set will be 8502.39.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other generating sets, other. The rate of duty will be 2.5 percent ad valorem.

The applicable subheading for the bed plate and foundation bolt will be 8503.00.9545, Harmonized Tariff Schedule of the United States (HTS), which provides for parts suitable for use solely or principally with the machines of heading 8501 or 8502, other, parts of generators. The rate of duty will be 3 percent ad valorem.

The applicable subheading for the subsole plates will be 8503.00.9560, Harmonized Tariff Schedule of the United States (HTS), which provides for parts suitable for use solely or principally with the machines of heading 8501 or 8502, other, other. The rate of duty will be 3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
